Order Making Policy

Consultation has concluded

The City of Onkaparinga is proposing to update Council’s Local Government Act - Order Making Policy pursuant to Local Government Act 1999 (the Act). The Policy will replace our existing Order Making Policy.

The draft Policy applies to those circumstances listed in section 254 of the Act which allow council to order a person to do or refrain from doing a thing under certain circumstances (outlined in the Act). This draft Policy also applies in respect of orders issued by council under Section 216 (power to order the owner of private road to carry out specified roadworks) and Section 218

This draft Policy also applies in respect of orders issued by council under Section 216 (power to order the owner of private road to carry out specified roadworks) and Section 218 (power to require owner of adjoining land to carry out specified work).

This consultation is focussed on establishing council’s policy position on:

  • Council’s approach to Order Making
  • The principles for authorised Officers in their considerations when exercising powers to order a person to do or refrain from doing a thing or where a recipient fails to comply with an order
  • How Council may use the order making powers available to it under the Act in such a way as to facilitate a safe and healthy environment, to improve the amenity of a locality and generally for the good governance of its area.
