The results of the public consultation phase were considered by Council at its meeting on 20 October 2020, where Council resolved to proceed with the revocation and sale process by seeking the approval of the Minister for Planning and Local Government. The Minister’s approval is yet to be received by Council.

Background
It is proposed to revoke the classification of a small portion of community land, being 45 square metres outlined in red on the attached aerial image, to enable the sale of the subject portion of land to the applicant and owner of 34 Helmsman Terrace, Seaford.
This will provide a more uniform property boundary and improve the outcome of the originally subdivided lands in 1967 and 1969, whereby a 45 square metre triangular portion of the reserve land was irregularly located between the front property boundary of 34 Helmsman Terrace and the road boundary.
The proposed revocation process proposed in this public consultation process, has no impact on a separate project to upgrade the larger portion of this reserve, which was subject to public consultation in late 2019 and is budgeted and planned for construction in the 2020/21 financial year.
If the subject land (45m2) is revoked from its community land classification and sold to the applicant and owner of 34 Helmsman Terrace, the land will be consolidated with the applicants existing land to form a single allotment.
